1. Acceptance of Terms

By accessing or using Smart Files ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Platform. We reserve the right to update these terms at any time, and continued use after changes constitutes acceptance.

2. Account Registration & Security

To use the Platform, you must create an account with accurate and complete information. You are solely responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use. We are not liable for any loss or damage arising from your failure to protect your account.

3. Acceptable Use

You agree to use the Platform only for lawful purposes and in compliance with all applicable laws. You must not:

• Upload malicious files, viruses, or harmful code.
• Attempt to access another user's account or data without authorization.
• Use the Platform to distribute spam, phishing content, or illegal material.
• Reverse-engineer, decompile, or attempt to extract the source code of the Platform.
• Violate the intellectual property rights of others through uploaded content.

4. Service Plans & Payments

We offer both free and paid subscription plans. Free plans are subject to daily usage limits and storage caps as described on our pricing page. Paid subscriptions auto-renew unless canceled. Refunds are handled on a case-by-case basis. We reserve the right to modify pricing with 30 days' notice.

5. Intellectual Property

The Platform, including its design, code, branding, and underlying technology, is owned by Smart Files. You retain ownership of the documents you upload. By uploading content, you grant us a limited license to process, store, and transmit that content solely for the purpose of providing the service to you.

6. Limitation of Liability

Smart Files is provided "as is" without warranties of any kind, either express or implied. We do not guarantee that the Platform will be uninterrupted, error-free, or secure at all times. In no event shall Smart Files be liable for indirect, incidental, or consequential damages arising from your use of the Platform, even if advised of the possibility of such damages.

7. Termination

We may suspend or terminate your account at any time for violation of these terms, extended inactivity, or at our discretion. Upon termination, your access to the Platform will cease. You may request export of your documents within 30 days of termination; after that, data may be permanently deleted.

8. Governing Law

These terms are governed by the laws of the jurisdiction in which Smart Files operates. Any disputes shall be resolved through binding arbitration, not in court, unless otherwise required by applicable law.
